These Terms & Conditions ("Terms") govern your access to and use of the Zibbi mobile application ("App", "Platform", "Zibbi"), owned and operated by Aystera Software Solutions LLP ("Aystera", "Company", "we", "us"), a company registered in India with its registered office at Block No A-20, 2, Manokamna Society 1, Ayodhya Twp, Tarsali, Vadodara, Gujarat 390009.
Zibbi is developed and made available exclusively for the students, faculty, and staff of Parul University ("University"). By downloading, accessing, or using Zibbi, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
Zibbi is intended for use by individuals affiliated with the University (students, faculty, and staff) who can provide a valid University ID at the time of registration. Aystera reserves the right to verify eligibility and suspend or terminate accounts that fail verification.
2. Account Registration
To use Zibbi, you must register using your name, phone number, University ID, and grant location access where required for order fulfilment. You are responsible for:
- Providing accurate and current information
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
3. Services Offered
Zibbi currently allows registered users to:
- Pre-order food for pickup from university foodcourts
The following features are under development and will be governed by additional terms once launched:
- Salon appointment booking
- Event registration (paid and unpaid university events)
Availability of features may change at Aystera's discretion, and features under development may be modified, delayed, or withdrawn prior to launch without liability to Aystera.
4. Orders and Payments
- All orders placed through Zibbi are subject to acceptance by the relevant university foodcourt vendor.
- Payments are processed through our payment gateway partner. By making a payment, you agree to our payment gateway partner's applicable terms in addition to these Terms.
- Aystera does not store your payment card, UPI, or bank details.
- Order cancellations, refunds, and applicable charges are governed by our separate Refund & Cancellation Policy, which forms part of these Terms.
5. User Conduct
You agree not to:
- Use Zibbi for any unlawful purpose or in violation of University policies
- Attempt to gain unauthorized access to the App, its systems, or other users' accounts
- Interfere with, disrupt, or place undue burden on the Platform's infrastructure
- Place fraudulent orders or misuse the payment or cancellation process
- Impersonate any person or misrepresent your affiliation with the University
Violation of these Terms may result in suspension or termination of your account, without prejudice to any other remedies available to Aystera or the University.
6. Vendor Relationship
University foodcourt vendors are independent third parties responsible for preparing and fulfilling orders placed through Zibbi. Aystera requires all onboarded vendors to hold a valid FSSAI (Food Safety and Standards Authority of India) license/registration, and vendor onboarding is subject to submission and verification of the same. Aystera facilitates the ordering and payment process but is not responsible for the quality, preparation, hygiene, or accuracy of food items provided by vendors. Any complaints regarding food quality should be raised through the in-app support channel and will be routed to the relevant vendor and/or University administration.
7. Intellectual Property
All content, branding, trademarks (including "Zibbi"), software, and technology underlying the App are the property of Aystera Software Solutions LLP or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the App without prior written consent.
8. Data of Minors
Zibbi is not intended for use by individuals under the age of 18 ("Minors"). Where any service is accessed by or on behalf of a Minor with information provided by an adult user, such use is subject to the Data of Minors provisions set out in our Privacy Policy, which the adult user is deemed to accept.
9. Limitation of Liability
To the maximum extent permitted by law:
- Aystera provides Zibbi on an "as-is" and "as-available" basis, without warranties of any kind, express or implied.
- Aystera is not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to order delays, vendor errors, or payment gateway issues.
- Aystera's total liability for any claim arising from your use of Zibbi shall not exceed the amount paid by you for the order or transaction giving rise to the claim.
- Aystera is not liable for any downtime, service interruption, or data loss caused by factors outside its reasonable control, including third-party service failures (including our payment gateway partner).
10. Suspension and Termination
Aystera reserves the right to suspend or terminate your access to Zibbi at any time, with or without notice, if you violate these Terms, misuse the Platform, or if your affiliation with the University ends.
11. Changes to the Service and Terms
Aystera may modify, update, or discontinue any part of Zibbi, and may revise these Terms from time to time. Continued use of the App after such changes constitutes your acceptance of the revised Terms. Material changes will be communicated via the App where feasible.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Courts at Vadodara, Gujarat shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
